Patents

A Canadian Patent gives the patentee the right to exclude others from making, using or selling in Canada the invention defined by the claims. The term of a patent expires 20 years from the date of application.

A Canadian patent application must be filed within one year of the first public disclosure anywhere by the applicant or by someone who obtained knowledge of the invention directly or indirectly from the applicant. Further, there must have been no public disclosure of the invention by others prior to the Canadian filing date, or priority date if this is claimed. A prior foreign patent of the same applicant is treated the same as any other publication for novelty purposes. The invention must be unobvious as of the earlier of the filing date and any priority date.

Annual maintenance fees are payable on pending applications and issued patents prior to the second and subsequent anniversaries of the filing date.

Industrial Designs

A Registered Canadian Industrial Design gives the owner an exclusive right to the design. The term of a registered design extends 10 years from the date of registration.

A Canadian industrial design application must be filed within one year of the first public disclosure or offer for commercial use of the design. To be eligible for registration, the design must be original.

The description of the design, along with the drawings and title, must provide an accurate picture of the design. The features of the design and the article of manufacture to which the design is applied must be clearly conveyed.
